Home Affairs accepts a citizenship certificate, a current Australian passport or, for citizenship by descent or adoption, an extract as proof of Australian citizenship, and accepts a full Australian birth certificate alone only for a person born in Australia before 20 August 1986. This document list comes from Home Affairs’ employer guidance on confirming citizenship; check the requirements of the organisation requesting proof.

Which document matches the situation?

The table summarises Home Affairs guidance for employers. It does not decide anyone’s status.

Citizenship circumstance Document in Home Affairs guidance Qualification or next step
Became a citizen by application Certificate, descent or adoption extract, or current Australian passport Check what the requesting organisation needs
Born in Australia before 20 August 1986 Certificate, current passport or full Australian birth certificate The birth certificate can stand alone
Born in Australia on or after 20 August 1986 Certificate or current passport; otherwise a full birth certificate plus a parent or grandparent document See the birth documents below
No adequate document Work out the basis of citizenship first Then apply for evidence if appropriate

What is proof of Australian citizenship?

Proof is a document that shows citizenship. It is not citizenship itself. The strongest single document is a section 37 notice, which is prima facie evidence of the facts it states. Home Affairs describes the certificate as an official document showing a person is an Australian.

Am I an Australian citizen?

Status depends on how citizenship was acquired, not on the papers held.

  • Born in Australia: check the date of birth and section 12. A parent who was a citizen or permanent resident at the birth, or ten years of ordinary residence, can be enough.
  • Born overseas to a citizen parent: check descent under section 16.
  • Holding a certificate: start with it. It is on Home Affairs’ list.

Citizen or permanent resident?

Residence does not make a person a citizen. Section 12 lets a parent’s permanent residence at the birth count for the child, which is a rule about the child’s birth, not about the parent’s own status.

Born in the UK?

A UK birthplace does not decide it. If a parent was an Australian citizen at the birth, check descent.

Which birth documents prove citizenship?

Born in Australia Birth-document position
Before 20 August 1986 A full Australian birth certificate can be enough
On or after 20 August 1986 A full birth certificate plus a document showing a parent named on it was a citizen at the birth

For the later group Home Affairs lists the parent’s citizenship certificate, or the parent’s Australian birth certificate if the parent was born before 20 August 1986. If the parent was born on or after that date, it lists a grandparent’s certificate or birth certificate. A certificate or current passport is listed for both groups.

This is a document rule. It does not state the earlier citizenship legislation.

Is a passport proof of citizenship?

Yes, a current Australian passport is on Home Affairs’ list. The list does not treat an expired passport as equivalent. The rules for applying for a passport are not covered here.

How do you get proof of citizenship?

  1. List what exists. Compare it with the table above.
  2. Work out the basis. Birth, descent or another route.
  3. Apply for evidence. Home Affairs directs applicants to ImmiAccount, one application per person; a child under 16 applies through a responsible parent.

What if citizenship status is unclear?

Problem Next step
A parent’s records are missing Find the gap in the chain of documents
Details differ between documents Compare them; Home Affairs says an incorrect certificate can be reissued
Proof is not enough Establish the basis, then consider a section 37 application
An evidence application was refused Read the notice; the ART can review it

What if evidence is refused?

A refusal to give a section 37 notice can go to the Administrative Review Tribunal under section 52(1)(g). The Administrative Review Tribunal Act 2024 s 18 sets the period by rules that cannot end before 28 days after the decision; read the notice for the date.

When to ask a lawyer

Proof fails when one link in the chain is missing, usually a parent's record, or when two documents disagree. Australian Migration Lawyers can trace the chain, establish the basis of the claim and prepare the evidence application, which makes a clean outcome more likely than lodging with the gap still open.
